Last updated June 23, 2026These Terms of Service ("Terms") govern your use of the Agenthusiast website at agenthusiast.com and the website design, build, hosting, and maintenance services we provide. Please read them carefully. By visiting our site, purchasing a plan, or otherwise working with us, you agree to these Terms.
01 Agreement to these Terms
These Terms form a binding agreement between you ("you," "client," or "your business") and Agenthusiast ("Agenthusiast," "we," "us," or "our"). They apply when you browse our website, submit an enquiry, book a call, purchase a plan, or use any service we provide.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree with any part of these Terms, please do not purchase a plan or use our services.
02 Definitions
- Services means the website design, development, hosting, security, maintenance, and support that Agenthusiast provides under a selected plan.
- Website means the website we design and build for you under your plan.
- Build fee means the one-time fee for designing and developing your Website.
- Care plan means the recurring monthly subscription that covers hosting, security, updates, and support.
- Client content means the text, images, logos, trademarks, and other materials you provide to us for use in your Website.
03 The services we provide
Agenthusiast designs, builds, hosts, secures, and maintains websites for small businesses. The exact scope of what we deliver depends on the plan you select and any written project details we agree on with you. Our services may include design and development, copywriting, hosting and SSL, security and software updates, content edits, monitoring, and ongoing support.
We may use artificial intelligence tools as part of how we research, design, build, and maintain your Website. We review the work we deliver, and you remain responsible for confirming that the finished Website is accurate and suitable for your business before it relies on it.
04 Plans, build fee, and care plan
Our pricing has two parts: a one-time build fee to design and build your Website, and a recurring monthly care plan that keeps it hosted, secured, updated, and supported. Current plans and prices are shown on our pricing page and are summarized below for reference:
- Starter: a one-time build fee plus the Starter care plan.
- Business: a one-time build fee plus the Business care plan.
- Premium: a one-time build fee plus the Premium care plan.
The prices shown on the pricing page at the time of purchase control. We may change our prices and plan features going forward, but a change will not affect the price of a care plan you are already subscribed to unless we give you reasonable advance notice. Prices are in United States dollars and do not include any taxes, which are your responsibility where they apply.
05 Billing, renewal, and payment
Payments are processed securely by Stripe. We do not collect, see, or store your full card details on our servers. By purchasing a plan you authorize Stripe to charge your payment method for the build fee and the recurring care plan.
The build fee is charged when you start your project. The care plan is a subscription that renews automatically each month on the date you signed up, and it continues until you cancel. If a payment fails, we may retry the charge, and we may pause hosting, updates, or support if a payment remains unpaid.
You are responsible for keeping your payment method current. You can manage or cancel your subscription from your account or by contacting us.
06 Cancellation and refunds
You may cancel your care plan at any time. When you cancel, your subscription stays active through the end of the current billing period and then stops renewing. We do not provide partial refunds for the unused portion of a billing period unless required by law.
The one-time build fee covers design and development work. Once we have started building your Website, the build fee is generally non-refundable because the work has been performed. If you cancel before work begins, contact us and we will work with you in good faith on a fair resolution.
What happens when you cancel: the Website belongs to you, but the hosting, security, updates, and support that we provide through the care plan end. To keep your Website online after canceling, you will need to arrange your own hosting or another provider. We will make a reasonable effort to help you export or transfer your site files on request.
07 Your responsibilities
To build your Website we may need materials from you, such as your logo, brand colors, text, images, and product or service details. You agree to provide client content that is accurate and that you have the right to use.
By giving us client content, you grant Agenthusiast a license to use, reproduce, and modify it solely to provide the services and build and maintain your Website. You represent that your client content does not infringe anyone else's rights and does not violate any law. Delays in providing client content may delay your project timeline.
08 Timeline and revisions
We aim to deliver builds quickly, typically within about 10 to 21 days depending on your plan and how quickly we receive what we need from you. Timelines are estimates, not guarantees, and they depend on the scope of your project and your responsiveness.
Each plan includes a reasonable number of revisions during the build so we can get your Website right. Work that goes beyond the agreed scope, such as a redesign, significant new functionality, or extra pages, may be quoted separately.
09 Ownership of your website
Your Website is yours. Once your build fee is paid, you own the final website we deliver for your business, including the custom design and the client content you provided. You are free to keep your Website even if you later cancel your care plan.
This ownership does not extend to third-party components, fonts, libraries, or platforms that carry their own licenses, or to the underlying tools, frameworks, and reusable code described in the next section.
10 Our tools and code
Agenthusiast retains all rights to the systems, processes, frameworks, templates, reusable components, and know-how we use to build and maintain websites, including anything developed before or independently of your project. Delivering your Website does not transfer ownership of these underlying tools to you. Nothing here limits your ownership of your own Website and client content as described above.
Unless you ask us not to, we may reference that we built your Website and may show it in our portfolio and marketing.
11 Third-party services
Our services rely on trusted third-party providers, which may include payment processing (Stripe), hosting and infrastructure, domain registrars, email delivery, form handling, analytics, and similar tools. Your use of those features is also subject to the third party's own terms and policies. We are not responsible for the acts, omissions, outages, or policies of third-party providers, though we choose them with care.
12 Acceptable use
You agree not to use our services or your Website to do anything unlawful or harmful, including to:
- publish content that is illegal, infringing, defamatory, or deceptive;
- distribute malware, attempt to breach security, or interfere with our systems or other clients;
- send spam or violate anti-spam, privacy, or consumer-protection laws; or
- misrepresent your identity or your authority to act for a business.
We may suspend or terminate services for a serious or repeated violation of this section.
13 Availability and support
We work to keep hosted websites fast, secure, and online, and we monitor them as part of the care plan. We do not guarantee uninterrupted or error-free service, since downtime can result from maintenance, third-party providers, or events beyond our control. Support is provided during normal business hours, and we aim to respond to requests promptly.
14 Disclaimers
We provide our services with reasonable care and skill. Except as expressly stated in these Terms, the services and your Website are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant any specific result from your Website, such as a particular level of traffic, search ranking, sales, or revenue. Search rankings and online performance depend on many factors outside our control.
15 Limitation of liability
To the fullest extent permitted by law, Agenthusiast will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the services or your Website.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services is limited to the amount you paid us for the services in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
16 Indemnification
You agree to indemnify and hold harmless Agenthusiast and its owners and personnel from any claims, damages, losses, and reasonable costs (including legal fees) arising out of your client content, your use of the services or your Website, or your violation of these Terms or of any law or third-party right.
17 Term and termination
These Terms apply for as long as you use our services or maintain a care plan. You may cancel as described above. We may suspend or terminate services if you materially breach these Terms, fail to pay, or use the services unlawfully. Sections that by their nature should survive termination, such as ownership, disclaimers, limitation of liability, and indemnification, will continue to apply.
18 Governing law
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Ohio will have jurisdiction over any dispute that is not resolved informally. We encourage you to contact us first so we can try to resolve any concern directly and in good faith.
19 Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page, and significant changes may be communicated to active clients. Your continued use of our services after an update means you accept the revised Terms.
